“I’m Waleed. I work on NEC4 and FIDIC contracts and sit as an adjudicator. I wanted my LinkedIn posts to sound like me, not like a machine, so I built Lettie to write from my real stories and check every clause. Now it can do the same for you.”

Don't shake hands on a Defect.
Under NEC4, it can leave the Contractor paying for someone else's repair.
I've seen a bad paint finish left in on a handshake. Nobody wrote down what was agreed…
…and later nobody remembered it. I've also seen one accepted without a penny off the Prices.
I understand why. Nobody wants a row over something that works.
The problem is that the defect correction period keeps running. Under 44.2, a notified Defect still has to be corrected before it ends. The other side can insist on that, and I've seen them do it.
If the Contractor had access and didn't correct the Defect in time, 46.1 kicks in. The Project Manager assesses what it would cost the Client to get someone else to do it, and the Contractor pays.
Leaving a Defect in can be the right call. It just has to go through clause 45.
Either side can propose changing the Scope so the Defect "does not have to be corrected" (45.1). If both are willing, the Contractor quotes reduced Prices, an earlier Completion Date, or both (45.2), and the Project Manager decides.
A quotation on that paint finish would have given everyone something to remember.
What's the last Defect you agreed to live with, and did anyone put a price on it?
